Acton Town Council Regular Meeting Minutes August 7, 2023 Approved

  1. Call to Order, Flag Salute, & Roll Call –  The meeting was called to order by President Jeremiah Owen at 6:34 pm.  Present at the meeting:  Jeremiah Owen, June Perkins, Tom Costan, and Kelly Teno  Zoom – Jacki Ayer
  2. Community Comments – None
  3. Announcements & Correspondence – None
  4. Representative Update – Jacki asked Chuck Bostwick from Supervisor Barger’s office if he knows the status of the 230 KB line franchise Agreement.  He is not for sure but will find out  Jacki Owens from Congressman Garcia’s office spoke about him having a mobile office day this Friday August 11, 2023.  She spoke about the Fire Prevention Act and use of drones to catch fires early.  Reminder of the new IRS filing date October 16, 2023.  We asked if the Congressman might be able to support our letter asking Supervisor Barger about the Census Bureau.
  5. Library Report – Summer programs are coming to an end Library will be closed Labor Day.

  7. Battery Project Update –  The ATC has received a letter from Regional Planning that Hecate Humidor project has been refiled.  The proposed project is now smaller and only on M-1 land, which means they only have to go through a Ministerial Review.  Their application is in but a permit hasn’t been issued.  Ruth Brock from Acton Takes Action has gone to the Fire Department and has gotten contact information.  She asked the Fire Chief if a brush fire were to start the BESS on fire what would they do.  They would look at it case by case and would shelter in place or evacuate as needed.  These answers just don’t work for our community.  There was discussion about Director Bodek’s letter and that she used the same reasons as she did before the motion to look into it even though this is know a new project.  It almost seems as if she had spoken with a utility company such as Edison about distribution vs. a transmission system.  Jacki pointed out that just because a project is ministerial doesn’t mean it is exempt from CEQA, if it will change a community.  Tom Costan made a motion to write a letter outlining the deficiencies in Director Bodek’s letter.  June Perkins 2nd the motion.  The motion carried.  In the discussion that followed the motion it was decided to add to the motion. Tom Costan amended to add – and ask for a moratorium until the report is complete.  The motion carried.
  8. Proposed RV Park – Santiago Rd –  We listened in on the One Stop meeting for the project, which is proposed on Santiago Road just North of the Acton Faith Bible property.  It will be able to house around 200 RV’s.  If the 2 proposed RV Parks go through Acton will have 5 RV Parks.  This proposed project could add around 20,000 people to our community.  All the septic waste will be going into our river bed.  They are proposing a restaurant and pool, which means lots of water usage.  Where will the water come from?  Another big issue is that the County doesn’t follow up on people living in these parks.  Jacki Ayer made a motion to write a letter in response to the new RV Park and issues with water use compliance and over concentration, waste, enforcement, and ingress & egress.  Tom 2nd the motion.  After discussion the motion carried.
  9. Fire Hazard Severity Zones –  The deadline for comments is Wednesday and Jacki sent a draft letter.  WE can’t get their maps without buying access, which is around $800.00.  It has been hard to make comments without seeing the maps they used.  CalFire should provide all the data to the public to make comment.  We should reach out to Assemblyman Lackey and Senator Wilk to ask for their help with CalFire and making the maps public.  Jacki Ayer made a motion to write a letter addressing their lack of transparency and not accounting for economic impact on individuals.  June Perkins 2nd the motion.  The motion carried.          Tom Costan made a motion to write a letter asking for help to access CalFire data base from Assemblyman Lackey and Senator Wilk.  June Perkins 2nd the motion.  The motion carried.
  10. 10. Election – Tom Costan, Kelly Teno, Troy Pieper and 1 empty seat up for election.  Jeremiah named the Election Committee- June Perkins and Jacki Ayer.  Jeremiah will fix all the dates on the application and post it, June will distribute around Acton.  Jeremiah will also reach out to Troy Pieper since he is moving out of state but hasn’t officially resigned.  There may be 2 empty seats.

  14. Councilmember Comments – we thanked everyone for coming
  15. Committee Reports –  The following Committees gave reports:  Planning and Coordinating – Regional Planning cancelled our meeting about the Fire Protection Ordinance.  We are still concerned and want to talk before going to the Board of Supervisors.  The Development Standards Ordinance passed, but Supervisor Barger made a motion to exempt Santa Clarita and the A.V. area from chain link fence.  Utilities – We had a zoom meeting with WWD37 in which we laid out our concerns involving usage, contamination, and asked them to attend a ATC meeting .  Josephine from Public Works will check when they can attend, possibly October.
  16. Unfinished/New Business –  Acton Faith Bible would like to attend an ATC meeting to discuss their CUP.  We will put them on the next Agenda.  Telecommunications CUP request, Regional Planning has said they have to comply with the new standards.  We need to add billboards near the telecommunication sites to our new business.  County should not issue a new CUP for a parcel that is not compliant with the billboard standards on the property.
